These terms are between you and LBC Studios Inc., [POSTAL ADDRESS] ("we", "us"), the maker of SwarmZ ("the game"). By installing or playing the game, or using the SwarmZ page at https://lbcstudios.ca/swarmz, you agree to them. If you do not agree, do not play. These terms are at https://lbcstudios.ca/swarmz/tos; how we handle your data is in our Privacy Policy.
1. The short version
- You may play the game for fun, for yourself, on your own devices.
- Gems, cards, packs and other game items have no cash value and cannot be traded or sold.
- You buy through Google Play; refunds follow Google's rules.
- Packs are random. The odds are shown before you buy or open one.
- Play fair. We may rename or remove player names and scores that break the rules.
- The game is provided as it is, and we may change or stop it.
2. Who can play
You must be 13 or older. If your country sets a higher age for using a service like this, or you are under the age of majority where you live, you need a parent or guardian to agree to these terms for you, and you may only buy things with their permission. We do not knowingly allow children under 13 to play. If you are a parent and think your child under 13 has used the game, write to us and we will delete their data.
3. Your licence to play
We give you a personal, non-exclusive, non-transferable, revocable licence to install and play the game on devices you own or control, for your own non-commercial entertainment. The game, its code, art, music, voice, text, names and logos belong to us or our licensors. You may not:
- copy, modify, reverse engineer or extract the game's code or assets, except where the law lets you;
- cheat, or use bots, macros, modified clients, emulators set up to cheat, or any tool that gives you an unfair advantage or sends false results to our servers;
- attack, overload or probe our servers, or try to reach data that is not yours;
- sell, trade, rent or give away your account, items or progress, or buy or sell them outside the game;
- use the game for any commercial purpose.
4. Your account and your progress
The game gives you an anonymous Player ID; there is no login. Your progress is saved on your device and copied to our servers. If you lose your device, we may not be able to give your progress back. You can delete your data at any time (Settings > Delete my data, or https://lbcstudios.ca/swarmz/delete). After you do, we cannot restore it.
5. Virtual items, purchases and random packs
Virtual items. Gems, alloy, materials, cards, packs, upgrades and similar things in the game are virtual items. You get a limited licence to use them in the game. They have no cash value, are not property, are not your money, and cannot be exchanged for money or anything outside the game. They cannot be transferred to anyone else. We may change what they do, and balance, replace or remove them.
Buying. Real-money purchases are made through Google Play and are subject to Google Play's terms, including the Google Play Payments policy. We check each purchase with Google before we deliver it. Prices are shown in your currency in Google Play before you pay, and include any taxes Google adds.
Refunds. Refunds follow Google Play's rules. Google says you may be able to get a refund if you ask it within 48 hours of the purchase; after that, you contact us. Read Google Play's refund policy (for the EEA and the UK, this page). A refunded purchase removes the items it gave. Outside Google's window, write to support@lbcstudios.ca with your Player ID and the order ID; we handle each request under Google's rules and the law that applies to you. Where the law gives you a right to cancel a digital purchase, you agree it ends once we start delivering the items, as far as the law allows.
Random packs. Some packs and rewards give random cards. Before you buy a pack or open one, the game shows you the odds of what it can give, in an "Odds" sheet next to the buy or open button. Packs follow the odds shown for their version, and we keep a record of which odds version each pack used. This is how Google Play requires odds to be shown: see the Google Play Payments policy, which asks that the odds of random items be disclosed in advance of, and close to, a purchase. We may change the odds for future packs; a change never applies to a pack you already opened. Packs and cards are for play only; they cannot be cashed out and they are not gambling.
6. Player names and conduct
If you pick a player name, other players may see it next to your scores. Names must be 3 to 20 letters, digits, spaces, underscores or hyphens. Your name and anything you send us must not:
- be offensive, hateful, sexual, or harass or threaten anyone;
- pretend to be us or another person, or contain someone's personal information;
- advertise anything, or contain links;
- be used to cheat or to hide a cheat.
We may rename you, remove your name, your score, your record or your prizes, reset your progress, or suspend or end your access, if you break these terms, cheat, or appear to; we decide, and we do not have to warn you first. Scores can be corrected or reset if we find a fault or cheating.
7. Rewards
Some game events reward players in in-game items only (gems, alloy, materials and cards), according to how they place. They are virtual items under section 5, have no cash value, and have no entry fee. There are no real-world prizes. If we ever offer a prize that is worth real money, it will have its own official rules, and nothing here promises one. A prize may be withheld if we find cheating or a fault.
8. Changes to the game and its availability
We may update, change, suspend or stop the game or any feature, at any time. We try to keep it running, but we do not promise it will always be available, free of faults, or that your progress or items will last forever. If we end the game altogether, we will give notice in the game or on this page where we reasonably can.
9. Ending these terms
You can stop playing and delete your data at any time. We can end your licence and your access if you break these terms, or if the law or a store requires it. When it ends, you must stop using the game, and sections that by their nature continue (items, liability, governing law) continue.
10. Disclaimers
The game is provided "as is" and "as available". To the extent the law allows, we make no promise that it is fit for a particular purpose, uninterrupted, or free of errors, and we disclaim every warranty and condition not set out here. The law where you live may give you rights that cannot be excluded; these terms do not take them away.
11. Limit of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, lost profits, lost data or lost virtual items, and our total liability for any claim about the game is limited to the greater of what you paid us through Google Play for the game in the 12 months before the claim and CAD $50. Nothing in these terms limits liability that cannot be limited by law, such as for fraud, or for death or personal injury caused by negligence, or your rights as a consumer where you live.
12. Changes to these terms
We may change these terms. We will update the date above, and for material changes tell you in the game or on this page. If you keep playing after a change takes effect, you accept it. If you do not accept it, stop playing and delete your data.
13. Governing law
These terms are governed by the laws of [PROVINCE], Canada, and the federal laws of Canada that apply there. Courts of [PROVINCE] have jurisdiction, except that if you are a consumer, you keep the right to bring a claim in your home courts and the protection of the mandatory consumer laws of where you live.
